FedEx Divisions Explained

FedEx Express: This division handles over 6,000,000 (six million) air shipments a day to businesses and residences throughout the world by operating the largest freight airline and a network of delivery vehicles. FedEx uses employees for this division. FedEx also provides the trucks, equipment, uniforms, vehicle fuel and facilities for the employees. This division is non union except for the airplane pilots.

FedEx Ground: Formerly known as RPS (Roadway Package System), this division delivers packages exclusively through a ground trucking network to businesses and residences throughout the United States. FedEx uses contractors for delivery who provide their own trucks, equipment, vehicle fuel, insurance and uniforms under the FedEx brand.

FedEx Home Delivery: This division started out delivering packages to residences but has since expanded to include deliveries to businesses using contractors who provide their own trucks, equipment, vehicle fuel, insurance and uniforms under the FedEx brand.

FedEx Kinko's: Kinko's (Keyway Inc.) was bought by FedEx in 2004 for $2.4 billion and operates more than 1,500 service centers with aproximately 22,000 employees and sales of over $2,066 million (2005).

FedEx Custom Critical: Non-stop, time-specific, door-to-door critical shipment delivery throughout the U.S. and Canada and within Europe. The custom critical fleet is made up entirely of owner operators who provide their own vehicles. FedEx Custom Critical is made up of the following divisions: Surface Expedite is exclusive-use nonstop, door-to-door delivery of critical freight. Air Expedite is an array of expedited air solutions. White Glove Service is for shipments requiring special care in handling, such as air-ride equipment or temperature control.

FedEx Freight: A provider of regional next-day and second-day and interregional LTL freight services. Its business segment reported annual revenues of $3.2 billion in the last fiscal year - FY05. Often handles bulk and shipments that weigh more than 150 lbs. Freight shipments are handled by employees either paid hourly or by the mile for linehaul.

Linehaul drivers drive only about 10 or so hours round trip. Mileage is paid but they also get some hourly pay for dropping and hooking, fueling and doing logs, etc.. A drop and hook run (with return) in under 11 hours could earn $80,000 yearly if it can be done 5 times a week 52 weeks a year although the driver may not be able to do it 5 times a week with the Department of Transportation (DOT) rules.

* FedEx Freight East: Formerly American Freightways.
* FedEx Freight West: Formerly Viking Freight.
* FedEx National LTL: Formerly Watkins Motor Lines.
* FedEx Freight Canada: Formerly Watkins Canada Express.
* Caribbean Transport Services (information needed).

FedEx Trade Networks: Provides a full range of international support services including customs clearance, freight forwarding, Trade & Customs Advisory Services (TCAS), trade technology solutions including full-service customs brokerage, global ocean and air cargo distribution. We are not sure if FedEx uses employees or contractors for this division.

FedEx Supply Chain Services: Supply chain management is the efficient and effective movement of goods and information from supplier to manufacturer to the end user. We are not sure if FedEx uses employees or contractors for this division.

FedEx Services: In June 2000 FedEx Services was created to provide information technology, sales and marketing support for FedEx subsidiaries FedEx Express and FedEx Ground. Today FedEx Services coordinates sales, marketing and technology support for the global FedEx brand including the data management and networking expertise behind the package tracking capabilities for FedEx Express, FedEx Ground and FedEx Freight. Customer Service was also recently added to the group.

FedEx SmartPost: Consolidates parcels, formerly the independent company Parcel Direct.

To all FedEx Ground and Home Delivery drivers

You may have seen or heard television and radio ads urging you to contact an attorney who promises a “big payday” for your claims against FedEx Ground for misclassifying you as independent contractors. These ads misleadingly suggest that your chances of recovery are greater if you go it alone against the Company. If you call these attorneys, they might even suggest that they can settle with FedEx Ground without even having to actually file a lawsuit. As you might have guessed, this is all a lot of hot air.

It is important to know that these attorneys likely do not possess any expertise in employment law and are merely telemarketers and “case forwarders” who attract potential plaintiffs with flashy advertising and misleading promises, only to send your case along to another attorney for a fee. What these lawyers fail to tell you is that your chances of a fair recovery on an individual basis is likely much less than they promise.

Because the current litigation concerning the employment status of virtually FedEx Ground’s entire workforce goes to the very heart of its business model, the Company has been fighting tooth and nail in any proceeding that touches this issue. For example, even though many state unemployment agencies have held FedEx Ground drivers to be employees, FedEx Ground continues to re-litigate this issue every time a new driver makes the same claim. Given this strategy by the Company, it is highly unlikely that FedEx Ground will settle with individual drivers. Because the employment status of its drivers is such a critical issue to the Company, we believe that FedEx Ground will only entertain settlement, if at all, on a nationwide basis so that it can be definitively resolved for the entire Company.

This strategy by FedEx Ground only makes sense because a defendant in any action that is subject to repetition, such as an individual suit by a driver against FedEx Ground based on misclassification, has no incentive to settle with any one driver. Why? Because it only sets a bad precedent that would encourage even more suits against it. This unwillingness to settle any individual suit is precisely the strategy of Pfizer in its much publicized Vioxx litigations.

Next time you are tempted by one of these misleading ads, we encourage you to find out what experience the advertising attorney has in fighting for employment rights. Also ask him why he thinks FedEx Ground would settle your claim individually when it makes no sense for it to do so. Don’t be surprised by the silence at the other end of the line. It’s just the advertising lawyer running out of hot air. Also, make sure that you understand the fees this lawyer will charge you. Will you have to pay a fee from any recovery that arises out of the class actions? Will the individual settlement that this lawyer wants preclude you from a class-wide settlement?
